We are pleased about your visit to our website. To ensure that you feel safe and comfortable when visiting our website, we take the protection of your personal data and its confidential treatment very seriously.

With these notes on data protection, we would therefore like to inform you about when we store which data and for what purpose we use it - naturally in compliance with the applicable data protection regulations.

 Constant technological development, changes to our services or the legal situation, and other reasons may require adjustments to our data protection notice. We therefore reserve the right to change this data protection declaration at any time and ask you to inform yourself regularly about the current status.

Basic information

Unless otherwise stated in the following sections, no personal data is collected, processed or used when using our websites.

When you access our Internet pages, our web servers automatically collect information of a general nature. This includes the type of web browser, the operating system used, the domain name of the Internet service provider, the IP address of the computer used, the website from which you visit us, the pages you visit on our site and the date and duration of the visit.

This data cannot be used by us to identify the individual user. The information is only statistically evaluated by us and used exclusively to improve the attractiveness, content and functionality of our websites.

Concept of personal data

The term personal data is defined in the German Federal Data Protection Act (‘Bundesdatenschutzgesetz’). Accordingly, this is individual information about personal or factual circumstances of a specific or identifiable natural person. This includes, for example, your civil name, your address, your telephone number or your date of birth.

In the EU General Data Protection Regulation (GDPR), which comes into force in May 2018, personal data is defined as follows:

Any information relating to an identified or identifiable natural person (hereinafter "data subject"); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Legal basis for the collection processing of personal data

Insofar as we obtain your consent for processing operations of personal data, Art. 6 para. 1 lit. a GDPR serves as the legal basis for the processing of your personal data.

When processing your personal data to fulfill a contract between you and the DGHO, Art. 6 (1) lit. b GDPR serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures.

Insofar as the processing of personal data is necessary for the fulfillment of a legal obligation to which our company is subject, Art. 6 (1) lit. c GDPR serves as the legal basis.

If the processing is necessary to protect a legitimate interest of our company or a third party and fundamental rights and freedoms of the data subject do not override the former interest, Art. 6 (1) lit. f GDPR serves as the legal basis for the processing.

Data deletion and storage period

The personal data of the data subject shall be deleted or blocked as soon as the purpose of the storage no longer applies. In addition, storage may take place if this has been provided for by the European or national legislator in Union regulations, laws or other provisions to which the controller is subject. Data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or performance of a contract.

Collection and processing of personal data

Personal data is only collected if you provide it of your own accord, for example to carry out an order, a survey, a competition or registration for personalized services. There, you will be informed about the intended processing purpose and, if necessary, asked for your consent to the storage.

The personal data collected within the scope of our websites will only be used without your consent for order processing or processing your inquiries. You can revoke your respective consent at any time with effect for the future.

Your data is encrypted before transmission and processing to protect it from access by unauthorized persons. Please note that unencrypted e-mails are not transmitted with access protection.

Your data will not be sold, rented or made available to third parties in any other way than described here. Personal data will only be transferred to governmental institutions and authorities within the framework of mandatory national legal provisions. Our employees, agencies and dealers are bound by us to the strictest confidentiality.

Contact

You have the option of contacting us via our e-mail address or the contact form. We will, of course, use the personal data provided to us in this way exclusively for the purpose for which you provide it when contacting us.

Insofar as we request information via our contact form that is not required for contacting us, we have always marked this as optional. This information is used to specify your request and to improve the processing of your request. Any communication of this information is expressly on a voluntary basis and with your consent. Insofar as this involves information on communication channels (for example, e-mail address, telephone number), you also consent to us contacting you via this communication channel, if necessary, in order to respond to your request.

Of course, you can revoke this consent at any time for the future. To do so, please contact our data protection officer, whose contact details you will find below.

Comment function

You have the option of registering online to comment on documents on Onkopedia. Your comments are only visible anonymously. This means that your name will be replaced by "Anonymous" and it will not be possible to draw any conclusions about your person. All registered users are entitled to comment.

For the technical implementation, each time you comment, we store the comment and your username.

Special membership

You have the option to register online to access extended Onkopedia content for a fee. This will make you a DGHO Onkopedia Special Member for 149.00 euros per year. Your payment can be made via Giropay, credit card, PayPal or bank transfer.

 If you have selected the payment method credit card or an online payment method (e.g. PayPal), we will forward you to the corresponding payment service provider after completion of the order. There, after entering your access data, you can order the payment via the service provider.

 By choosing PayPal as a payment option, you consent to the transmission of personal data required for payment processing. The provider is PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg. Data is transmitted that is required for payment processing. The privacy policy of PayPal is available at https://www.paypal.com/de/webapps/mpp/ua/privacy-full.  Information on the duration of storage can be obtained from the operator or at https://www.paypal.com/de/webapps/mpp/ua/privacy-full. The user has the possibility to revoke the given consent at PayPal at any time. A revocation of data that is mandatory for payment processing is not possible.

If you choose Giropay during the process, it is a payment via your checking account. As a joint project of German banks, Giropay does not collect any separate data; instead, the payment is made via online banking.

During the registration process you assign a personal password. After your registration and successful payment you will receive your user name from us. The DGHO cannot read the passwords in plain text. For accounting and billing purposes, your data will be stored and kept according to the legal retention periods.

Members of the DGHO, as well as the participating Swiss and Austrian professional societies, can log in directly to Onkopedia with the corresponding member logins of their professional societies and view and comment on the extended content.

Data transfer to other companies

As a matter of principle, your data will not be transferred to third parties outside the DGHO, unless we are legally obliged to do so, or the transfer of data is necessary for the performance of the contractual relationship, or you have previously expressly consented to the transfer of your data. Your data will only be passed on to DGHO Service GmbH as an affiliated company so that you can benefit from your membership of the DGHO in the context of events organized by the same.

External service providers and partner companies will receive your data only to the extent necessary to process your request. In these cases, however, the scope of the transmitted data is limited to the necessary minimum. Insofar as our service providers come into contact with your personal data, we ensure that they comply with the provisions of data protection laws in the same way. Please also refer to the respective data protection notices of the providers. The respective service provider is responsible for the content of third-party services, whereby we check the services for compliance with the legal requirements within the scope of reasonableness.

Data transfer to external service providers (processors)

Your data will be shared with service partners to the extent that they act on our behalf and assist DGHO in providing their services.

Processing of your personal data by contracted service providers takes place within the framework of commissioned processing in accordance with Art. 28 GDPR.

The aforementioned service providers will only have access to such personal information that is necessary for the performance of the respective activity. These service providers are prohibited from disclosing your personal information or using it for other purposes, in particular for their own promotional purposes.

Insofar as external service providers come into contact with your personal data, we have taken legal, technical and organizational measures as well as regular checks to ensure that they also comply with the applicable data protection regulations.

A commercial transfer of your personal data to other companies does not take place.

Cookies

In some areas of our pages, so-called cookies are used. A cookie is a small text file that is stored on your hard drive by a website. Cookies do not cause any damage to your computer and do not contain viruses. The cookies on our website do not collect any personal data. We use the information contained in cookies to make it easier for you to use our pages and to tailor them to your needs.

Both session cookies and permanent cookies are used on our site. Session cookies are temporary cookies that are stored in the user's Internet browser until the browser window is closed and the session cookies are deleted. Persistent cookies are used for repeated visits and are stored in the user's browser for a certain period of time (usually 1 year or longer). These cookies are not deleted when the browser is closed. This type of cookie is used to reuse a user's preferences once they return to the site.

Of course, you can also view our website without cookies. If you do not want cookies to be stored on your computer, you can deactivate the corresponding option in the system settings of your browser. You can delete stored cookies in the system settings of your browser at any time. You can find out how this works in detail from the instructions of your browser manufacturer. However, we would like to point out that our website may only be usable to a limited extent without cookies.

Social Bookmarks

So-called social bookmarks (e.g. from Facebook) are integrated on our website. Bookmarks are Internet bookmarks with which the users of such a service can collect links and news messages. These are only integrated on our website as a link to the corresponding services. After clicking on the embedded graphic, you will be redirected to the page of the respective provider, i.e. only then will user information be transmitted to the respective provider. For information on how your personal data is handled when using these websites, please refer to the respective provider's privacy policy.

Youtube
On our website we have integrated videos of the provider YouTube (YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA, represented by: Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA). When you play a video, a connection to a YouTube server is established. If you are logged in as a member of YouTube at the same time, YouTube assigns this information to your personal user account.

When using the service, such as clicking the start button of a video, this information is also assigned to your user account.

You can prevent this by logging out of your YouTube user account and other user accounts of the companies YouTube LLC and Google Inc. before using our web pages and deleting the corresponding cookies of these companies in your browser. Further information on data protection by YouTube can be found at www.google.de/intl/de/policies/privacy/.

Data security

The DGHO uses technical and organizational security measures in order to protect the data we have under our control against accidental or intentional manipulation, loss, destruction or against access by unauthorized persons. Our security measures are continuously improved in line with technological developments.

Rights of the data subjects

If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights against the responsible person: 

  • Right to information according to Article 15 GDPR

You can request confirmation from us as to whether personal data concerning you is being processed by us. If we have processed data relating to you, you have further rights of access set out in Article 15 of the GDPR.

  • Right to rectification

If the data we have collected from you is incorrect or incomplete, you may request that we correct it without delay in accordance with Article 16 of the GDPR.

  • Right to restriction of processing

Under the conditions of Article 18 of the GDPR, you may also, under certain circumstances, request the restriction of the processing of personal data concerning you.

After the restriction, your data may only be processed with your consent or for the establishment, exercise or defense of legal claims, or for the protection of the rights of another natural or legal person, or for reasons of important public interest of the Union or a Member State. We will inform you before the restriction is lifted.

  • Right to deletion

If one of the reasons in Article 17 (1) GDPR applies, you can demand that we delete the personal data relating to you without delay, unless there is an exception to the obligation to delete in accordance with Article 17 (3) GDPR.

  • Right to information

If you have asserted the right to rectification, erasure or restriction of processing against us, we are obliged to inform all recipients of your personal data of this in accordance with Article 19 of the GDPR, unless the notification is impossible or involves a disproportionate effort. You also have the right to be informed about the recipients. You have the right against the controller to be informed about these recipients.

  • Right to data portability

In addition, you have the right under Article 20 of the GDPR to obtain from us the personal data concerning you in machine-readable format and to transfer the data to another controller without hindrance, provided that the conditions of Article 20(1)(a) of the GDPR are met, or to have your personal data transferred directly from us to another controller, insofar as this is technically feasible and no freedoms and rights of other persons are thereby impaired. This right does not apply to the processing of personal data necessary for the performance of a task carried out in the public interest or for the exercise of official authority.

  • Right of objection

You have the right to object at any time to the DGHO to the processing of personal data concerning you pursuant to Art. 6 (1) lit. f GDPR.

We will no longer process your personal data unless legitimate grounds for the processing override your interests, rights and freedoms, or the processing serves to assert, exercise or defend legal claims.

  • Right to revoke the declaration of consent under data protection law

You have the right to revoke your declaration of consent under data protection law at any time by declaration to the DGHO. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.

  • Right to complain

You have the right to lodge a complaint with a supervisory authority if you believe that the processing of data violates the General Data Protection Regulation.

Changes to the privacy policy

This privacy policy will be adapted continuously in the course of further development of the Internet or our offer. We will announce any changes on this page in good time. In order to be informed about the current status of our data usage regulations, this page should be called up regularly.
